1. Acceptance of Terms
Welcome to Aura Wonder. By accessing or using our AI-powered virtual try-on service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.
These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and Aura Wonder ("we," "us," or "our").
2. Service Description
Aura Wonder provides AI-powered virtual try-on services for fashion boutiques and retailers. Our Service enables your customers to:
- Send photos of themselves and clothing items via Instagram Direct Messages
- Receive AI-generated images showing them wearing the clothing
- Experience virtual try-on through automated Instagram DM interactions
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract to use our Service. By registering, you represent and warrant that you meet these requirements.
3.2 Account Information
- You must provide accurate, current, and complete information
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities under your account
- You must notify us immediately of any unauthorized access
3.3 Business Use Only
Our Service is intended for business use by fashion boutiques, retailers, and brands. Personal use for non-commercial purposes is not permitted.
4. Instagram Integration
4.1 Instagram Business Account Required
To use our Service, you must have an Instagram Business or Creator Account connected to a Facebook Page. You authorize us to access your Instagram account via OAuth to:
- Receive Instagram Direct Messages sent to your business account
- Send automated responses and AI-generated try-on images
- Manage messaging interactions with your customers
4.2 Compliance with Meta's Terms
You agree to comply with Instagram's Terms of Service, Meta's Platform Terms, and Community Guidelines. Any violation may result in termination of our Service.
4.3 Revocation of Access
You may revoke Instagram access at any time through your dashboard or Instagram settings. Revoking access will disable virtual try-on functionality until re-authorized.
5. Subscription and Billing
5.1 Subscription Plans
We offer the following subscription tiers:
- Starter: $29/month - 200 try-ons
- Growth: $79/month - 700 try-ons
- Pro: $199/month - 2,000 try-ons
- Scale: $449/month - 5,500 try-ons
Pricing and quotas are subject to change with 30 days' notice to existing customers.
5.2 Payment Terms
- Subscriptions are billed monthly in advance via Stripe
- All fees are non-refundable except as required by law
- You authorize recurring charges to your payment method
- Failed payments may result in service suspension
5.3 Quota Usage
- Each successful try-on request counts toward your monthly quota
- Quotas reset on your billing date each month
- Unused quota does not roll over to the next month
- Exceeding quota will result in service suspension until upgrade or next billing cycle
5.4 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to the Service until that date.
6. Acceptable Use Policy
6.1 Prohibited Activities
You agree NOT to:
- Use the Service for illegal, harmful, fraudulent, or unlawful purposes
- Upload inappropriate, offensive, defamatory, or copyrighted images without proper authorization
- Attempt to reverse engineer, hack, or compromise our systems or security measures
- Abuse, harass, threaten, or spam customers through our platform
- Resell, redistribute, or create derivative works from our Service without written authorization
- Use automated tools to abuse quotas, bypass rate limits, or overwhelm our systems
- Violate any applicable laws, regulations, or third-party rights
- Process images of minors under 18 years of age
- Upload explicit, violent, or otherwise inappropriate content
6.2 Your Content Responsibilities
YOU ARE SOLELY RESPONSIBLE for all images, content, and communications processed through our Service.
You represent and warrant that:
- You have all necessary rights, licenses, and permissions to use submitted images
- Images do not infringe on any third-party intellectual property, privacy, or publicity rights
- You have obtained proper consent from your customers to process their images
- You comply with all applicable privacy laws (GDPR, CCPA, etc.)
- You inform your customers about AI processing and obtain their consent
6.3 Customer Consent Requirement
You must obtain appropriate consent from your end customers before using our Service to process their images. You are responsible for informing them that their images will be processed by AI and immediately deleted after processing.
7. Data and Privacy
7.1 Data Processing
Our processing of personal data is governed by our Privacy Policy. By using the Service, you agree to our data practices as described therein.
7.2 Customer Images - No Permanent Storage
🔒 IMPORTANT: We do NOT save or permanently store customer images.
- Customer images are processed in real-time only
- Images are immediately deleted after processing completes (typically 4-10 seconds)
- No permanent storage or retention of personal photos
- We do not use customer images for AI training
- You retain all rights to customer data and interactions
7.3 Data Security Acknowledgment
While we implement industry-standard security measures, you acknowledge that:
- No system is completely secure
- You are responsible for securing your own account credentials
- We are not liable for unauthorized access due to circumstances beyond our reasonable control
- You must immediately report any security concerns to us
8. Intellectual Property
8.1 Our Intellectual Property
The Service, including software, algorithms, AI models, designs, and trademarks, is owned by Aura Wonder and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service for its intended purpose.
8.2 Generated Images
AI-generated try-on images are provided for your business use. You may use these images in your marketing and customer communications. We retain no rights to these generated images.
8.3 Feedback
Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution.
9. Service Availability
9.1 Uptime
We strive for 99.9% uptime but do not guarantee uninterrupted service. Maintenance, updates, or technical issues may cause temporary unavailability.
9.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service with or without notice. We are not liable for any modifications or discontinuation.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.
We specifically do not warrant that:
- The Service will be error-free, uninterrupted, secure, or available at all times
- Defects or errors will be corrected promptly or at all
- AI-generated images will be accurate, realistic, or meet your specific expectations
- The Service is free from viruses, malware, or other harmful components
- The Service will meet your business requirements or generate any specific results
- The quality of any products, services, or information obtained through the Service
AI Limitations: AI-generated images may contain errors, artifacts, or unrealistic representations. Results vary based on input quality and other factors beyond our control. You are responsible for reviewing all generated content before use.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
IN NO EVENT SHALL AURA WONDER, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Lost profits, revenue, sales, data, or business opportunities
- Loss of goodwill or reputation
- Service interruptions, delays, or downtime
- Errors, inaccuracies, or defects in AI-generated images
- Unauthorized access to or alteration of your account or data
- Costs of procurement of substitute services
- Any claims by third parties, including your customers
- Any use or inability to use the Service
THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
MAXIMUM LIABILITY: Our total aggregate liability for all claims arising from or related to the Service shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Aura Wonder, its affiliates, and their respective directors, officers, employees, agents, contractors, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees and court costs) arising from or related to:
- Your use or misuse of the Service
- Your violation of these Terms or any applicable law or regulation
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
- Any content, data, or images you submit or process through the Service
- Your failure to obtain proper consent from your customers
- Your customers' use, misuse, or claims related to AI-generated images
- Any disputes between you and your customers
- Any representation or warranty made by you to your customers about the Service
- Your breach of any obligation or duty to third parties
This indemnification obligation will survive termination of these Terms and your use of the Service. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
13. Termination
13.1 Termination by You
You may terminate your account at any time by canceling your subscription through the dashboard or contacting support.
13.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms or our Acceptable Use Policy
- Your account poses security or legal risks
- Payment fails after reasonable attempts to collect
- We discontinue the Service (with 30 days' notice)
13.3 Effect of Termination
Upon termination, your access to the Service ends immediately. Data may be deleted after 90 days unless legally required to retain it.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
14.2 Arbitration
Any disputes shall be resolved through binding arbitration in accordance with the rules of [Arbitration Provider], except for claims that may be brought in small claims court.

16. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Aura Wonder
- Severability: If any provision is invalid, the rest remains in effect
- No Waiver: Failure to enforce any right does not waive that right
- Assignment: You may not assign these Terms; we may assign without notice
- Force Majeure: We are not liable for delays due to circumstances beyond our control
